Smith Wins Smith v. Nelson challenges a South Dakota law that makes US Citizenship a requirement for obtaining a Concealed Carry License. This case closely mirrors similar cases that have been brought, and won, in Washington and Kentucky. The issue of how the equal protection clause of the 14th Amendment applies to aliens is well settled laws. The courts have consistently held that aliens do not meet the high standard required for declaring them a suspect class and thus denying them equal protection.
