Jennings v. BATFE (was D'Cruz v/ BATFE) seeks to establish the fundamental right of adults ages 18-20 to keep and bear arms under the Second Amendment.

The Gun Control Act of 1968 prevents licensed dealers from selling handguns to anyone under 21 years of age.  Having the right to keep and bears arms affirmed by the the Heller and McDonald decisions, a court must now decide if persons 18-20 years old should continue to be prevented from exercising that right.

This case was filed on September 8, 2010 along with another suit challenging a Texas state ban on issuing Concealed Handguns Licenses to 18-20 year old.  D'Cruz v. McGraw.

This case is supported by the National Rifle Association.  Charles J. Cooper is the plaintiff's attorney.

• 2/11/2011 - Case was renamed Jennings v. BATFE after lead plaintiff James D'Cruz moved with his parents to Florida effectively mooting his case.  The new individual plaintiffs are Rebekah Jennings, Brennan Harmon and Andrew Payne.
